IN THE HIGH COURT OF JUDICATURE AT PATNA

Criminal Miscellaneous No.30258 of 2014 Arising out of PS.Case No. -154 Year- 2014 Thana -PATNA COMPLAINT CASE District- PATNA ====================================================== Birendra Chaudhary Nirmal, aged about 36 years, son of Sri Prem Chaudhary alias Prameshwar Chaudhary resident of Road No. 13 (B) Rajendra Nagar, P.S. - Bahadurpur, District - Patna. .... .... Petitioner/s

Versus

The State of Bihar. .... .... Opposite Party/s ====================================================== Appearance :

For the Petitioner/s :

Mr. Vijay Kumar, Advocate.

For the Opposite Party/s: Mr. Raj Kishore Singh (APP) ====================================================== CORAM: HONOURABLE MR. JUSTICE MIHIR KUMAR JHA ORAL ORDER 14-01-2015 Heard learned counsel for the parties.

Having regard to the admitted position that the cheques amounting to Rs. 1,20,000/- were given by the petitioner to the informant and they have got bounced, there would be no difficulty in holding that the petitioner would be liable to pay the amount to the complainant. The only plea taken by the petitioner either before the court below or this Court that such cheques were stolen, does not inspire confidence because the cheques ultimately were passed with the signatures of the petitioner. It is not the case of the petitioner that he had put his cheques with his signatures and such cheques bearing his signatures were stolen.

That being so, this Court is not inclined to grant anticipatory bail to the petitioner. The prayer for anticipatory bail of the petitioner is hereby rejected.
