2. The petitioner has preferred this application for grant of regular bail in connection with Falka P.S. Case No. 171 of 2024 registered for the offences punishable u/s 310(4)/310(5) of B.N.S. and Section 25(i-b)a, 26 and 35 of the Arms Act and he has three criminal antecedents.

3. As per the prosecution case, one country made pistol, three live cartridges and a mobile phone were recovered from the possession of the petitioner.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is further submitted that the petitioner has no concern with the alleged recovery. It is next submitted that similarly

No.15596 of 2025(3) dt.09-05-2025 2/2 situated co-accused person has already been granted bail by the co-ordinate Bench of this Court vide order dated 03.03.2025 passed in Cr. Misc. No. 5388 of 2025. It is lastly submitted that the petitioner has three criminal antecedents and is in custody since 06.10.2024.

5. Learned APP for the State has vehemently opposed the prayer for bail of the petitioner.

6. Considering the aforesaid submissions of the parties and also considering the period of custody, let the petitioner above-named, be enlarged on bail on furnishing bailbonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Katihar, in connection with Falka P.S. Case No. 171 of 2024.

7. The application stands allowed.
