This is an application for bail in connection with Manjhi P.S. Case No. 117 of 2017 registered for the offences punishable under Sections 414, 420, 379, 467, 468 and 471 of the Indian Penal Code.

Allegation against the petitioner is that from his possession a number of ATM cards were recovered, for which he has no satisfactory explanation.

Submission of learned counsel for the petitioner is that nothing has been recovered from his possession, rather from the vehicle in which he was traveling as a passenger. Further submission is that similarly situated co-accused has already been granted bail in Cr.Misc.No. 38323 of 2017, vide order dated 21.8.2017 by a co-ordinate Bench of this Court and petitioner is in

Patna High Court Cr.Misc. No.41278 of 2017 (2) dt.07-09-2017 2/2 custody since 31.6.2017.

Having heard both sides and in view of facts and circumstances, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran at Chapra, in connection with Manjhi P.S. Case No. 117 of 2017, and before release the court below will verify authenticity of his bail bonds, subject to the following conditions :- (1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned, (2) Petitioner will mark his attendance in local police station in first week of every month till conclusion of trial, failing which his bail bond shall be cancelled.
