The petitioner apprehends his arrest in a case under Section 307 and other sections of the Indian Penal Code. The petitioner is alleged to have assaulted the informant Sandeep Kumar Singh with iron rod on his head but the injury found on the head is simple in nature. Other accused persons have already been granted anticipatory bail by the learned Sessions Judge because there was omnibus and general allegation. However, one of the injured Suraj Kumar Singh got grievous injury on account of fracture in his finger. The assailant of Suraj Kumar Singh has also been granted anticipatory bail. There is a counter-version.
Considering the facts aforesaid, the above named petitioner, in the event of his arrest or surrender before the learned
Patna High Court Cr.Misc. No.23255 of 2015 (2) dt.08-07-2015 2/2 court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Vivek Rai, Judicial Magistrate, Chapra, in Rasulpur P.S. Case No. 10/2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
