ANJANA MISHRA ORAL ORDER 05-07-2018 Heard the learned counsel for the petitioner and counsel appearing on behalf of the State.

The petitioner is in custody since 31.03.2018 in connection with Maharajganj P.S. Case No.173 of 2017, registered under Sections 302/34 of the Indian Penal Code.

The learned counsel for the petitioner submits that he is neither named in the FIR nor has any allegation made against him. She is merely an agnate and of the same village. The learned counsel further submits that the name of the present petitioner has surfaced only during the course of confessional statement made before the police by the co-accused. Further, there is no material against the petitioner.

In view of the aforementioned facts and circumstances of

No.33177 of 2018 (3) dt.05-07-2018 2/2 the case and the fact that the confessional statement made before the police has no substance, let the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-V, Siwan, in connection with Maharajganj P.S.
