Petitioner is in custody in connection with Kotwali P.S. Case No. 13 of 2018 for offence under Section 379 of Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has not been named in the FIR. He was apprehended by the police later on and the police have taken the confessional statement by using third degree. Nothing was recovered from the possession of petitioner. Petitioner is in custody since 16.02.2018.

Considering the fact that the petitioner has not been named in the FIR and nothing was recovered from his possession, let the petitioner, above named, be released on bail

Patna High Court Cr.Misc. No.32853 of 2018(2) dt.04-06-2018 2/2 on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Kotwali P.S. Case No. 13 of 2018.
