The petitioner seeks bail in Begusarai (Muffasil) P.S. Case No. 173 of 2017 registered under Sections 366A and 363 of the Indian Penal Code.
The minor daughter of the informant is said to have been kidnapped by the petitioner with intention to perform marriage with her.
It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in this case. The victim in her statement recorded under Section 164 of the Code of Criminal procedure has not alleged any overt act against the petitioner. The petitioner has been languishing in custody since
Patna High Court Cr.Misc. No.39715 of 2017 (2) dt.21-08-2017 2/2 08.05.2017.
Learned APP opposing the prayer for bail submitted that the victim is a minor girl aged about 14 years. She was recovered from the house of the petitioner.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for bail is rejected. However, the petitioner may renew his prayer for bail after six months.
