It has been submitted on behalf of the informant that present appeal is not maintainable in the light of order dated 07.11.2019 passed in Cr. Misc. No. 52792 of 2019, since, the impugned order has been passed by learned Special Judge POCSO, Saharsa and only a criminal miscellaneous petition would lie.

Learned counsel for the appellant seeks permission to convert this appeal into a Criminal Miscellaneous Case. Two weeks time is granted for the aforesaid purpose to the learned counsel for the appellant to convert this appeal
