This is an application for bail in connection with Madanpur P.S.Case No. 230 of 2012 registered for the offences punishable under Sections 396 and 397 of the Indian Penal Code. Petitioner is not named in the FIR. However, his name transpires in the confessional statement of co-accused and he is accused in three other cases also.

It has been submitted on behalf of the petitioner that except confessional statement there is nothing against him and he is in custody for seven months.

Heard learned APP also.

Having heard both sides and from perusal of the record it appears that the case is of the year 2012 and impugned

Patna High Court Cr.Misc. No.34605 of 2017 (2) dt.31-07-2017 2/2 order shows that he was absconding since 2013 and because of that there is delay in disposal of the present case, I am not inclined to grant bail to the petitioner.

However, learned trial court is directed to expedite the trial and try to conclude it within nine months. With the above observation, this application is dismissed.
