JUSTICE SATYAVRAT VERMA ORAL ORDER 08-04-2022 Heard learned counsel for the petitioners and learned A.P.P. for the State through virtual Court proceedings. The petitioners seek bail in a case registered for the offences punishable under Sections 472 and 473 of the Indian Penal Code read with Sections 30(a) and 33 of the Bihar Excise Act.

Learned counsel for the petitioners submits that the petitioners are in custody since 12.01.2022, are persons with clean antecedent and charge-sheet has been submitted in the case.

Allegation is of recovery of 15 litres of spirit from a

Patna High Court CR. MISC. No.16951 of 2022(2) dt.08-04-2022 2/2 Toyota Car and 25 litres spirit from a Honda City Car along with some other articles.

Learned counsel for the petitioners submits that the petitioners were not arrested from the spot nor were owner of the said vehicle. It is further submitted that the name of the petitioners transpired based on the disclosure made by the local people as would appear from the F.I.R.

Learned A.P.P. for the State opposes the prayer for bail of the petitioners.

Considering the fact that the petitioners are in custody, are persons with clean antecedent and charge-sheet has been submitted in the case, let the petitioners above named be released on bail on furnishing bail bond of Rs. 3,000/- (Rupees Three Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Bettiah Muffasil Manuapul P.S. Case No. 477 of 2021.
