Heard learned Additional Public Prosecutor for the State. No one appears for the petitioner.

The petitioner is languishing in custody for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Earlier prayer for bail to the petitioner was allowed on 04.12.2019 in Cr. Misc. No.78817 of 2019 with condition that petitioner shall be released after framing of the charge. Allegation is that from a pickup van 1200 liters of spirit was recovered and the petitioner was there in the said van. Petitioner has got no criminal antecedent and he is in custody since 17.10.2019.

Patna High Court CR. MISC. No.14014 of 2020(3) dt.24-08-2020 2/2 Petitioner has stated on oath that though the petitioner is appearing before the Court-below but charges have not been framed. In the meantime, other co-accused have been allowed bail by different coordinate Benches of this Court. Considering the entire facts aforesaid, let the petitioner, above named, be released immediately on bail immediately on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Taraiya P.S. Case No.311 of 2019, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
