JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-06-2018 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Special Case No. 453 of 2018 for the offence under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent and he has remained in custody since 13.04.2018. He has also submitted that the seizure list was not prepared in accordance with the mandatory provision of the Code of Criminal Procedure.

Considering the facts that the petitioner has no criminal antecedent and he has remained in jail for nearly two months, let the petitioner, above named, be enlarged on bail on

Patna High Court Cr.Misc. No.31950 of 2018(2) dt.05-06-2018 2/2 furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the 2nd Additional Sessions Judge, Excise Act, Araria in connection with Special Case No. 453 of 2018.
