====================================================== CORAM: HONOURABLE DR. JUSTICE RAVI RANJAN ORAL ORDER 19-08-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered for offences punishable under Sections 399, 402, 353 of the Indian Penal Code, Sections 25 (1-B)A, 26, 35 of the Arms Act and Section 30 (A) of Bihar Excise Amendment Act.

It is contended that, as per allegation, the police raided the place where the petitioner and others were planning to commit bank dacoity and three persons were apprehended and four persons managed to escape. From the possession of the petitioner, two live cartridges were recovered. 40 bottles of 375 ml. foreign liquor were also recovered from the vehicle. It is contended that the persons from whom arms were recovered, have been granted bail by different coordinate Benches of this Court vide Cr. Misc. No. 34910/2017 & Cr. Misc.

Patna High Court Cr.Misc. No.36382 of 2017(2) dt.19-08-2017 2/2 No.35465/2017. It is urged that the petitioner is in custody since 8.05.2017. It is claimed that his antecedent is clean. Considering the facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II-cum-Special Judge (Excise), Jehanabad in connection with Excise Case No.570/2017 arising out of Kako P.S. Case No.101/2017 with a condition that if the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds.
