The petitioner is apprehending his arrest in connection with Rajiv Nagar P.S. Case No. 231 of 2018 registered for the offences punishable under Sections 420, 409/34 of the Indian Penal Code.

Learned Senior Counsel representing the petitioner submits that this petitioner happens to be the Director of Navicon Infotech Private Limited. The allegation against him is that he along with one of the employees of the informant's company got delivered 3500 devices indirectly to Navicon Infotech company causing a loss of Rs. 20 lakhs to the informant. Learned Senior Counsel submits that the allegations are in the nature of dispute over certain

Patna High Court CR. MISC. No.15735 of 2019(2) dt.15-03-2019 2/2 commercial transactions and by no stretch of imagination it can be said to be a matter which would give rise to a criminal proceeding. Learned APP has opposed the prayer of anticipatory bail of the petitioner by submitting that there are allegations against the petitioner that he had caused loss to the informant's company. Considering the facts and circumstances of the case wherein this petitioner is said to be a Director of the company who has received certain supply with respect to which there are disputes, let the petitioner above named, in the event of his arrest or surrender within a period of four weeks from today in connection with Rajiv Nagar P.S. Case No. 231 of 2018, be enlarged on bail on furnishing of bail bond of Rs.

15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Patna, subject to the condition that he will co-operate in course of investigation by reporting to the Investigating Officer within two weeks from today. This will be in addition to the condition laid down under Section 438 (2) of the Cr.P.c.
