JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-06-2019 This application, for grant of anticipatory bail, arises out of Raxaul P.S. Case No. 81/2018, disclosing offences under Sections 467, 468, 471, 420 of the Indian Penal Code. Allegation as per F.I.R. is that the petitioner took a policy in the name of his wife from Aditya Birla Sun Life Insurance Company Limited and after seventeen days of issuance of policy, the petitioner claimed the amount of policy showing his wife to be dead, however, on the enquiry, it transpired that his wife has died one year ago prior to taking of the policy and thus, the petitioner attempted to cheat the company on the basis of forged and fabricated death certificate issued by the doctor.

Submission of learned counsel for the petitioner is that he has falsely been implicated int his case and no money

Having heard both sides, considering the facts and circumstances of the case, this application is allowed. Let the petitioner before the court below on 10.07.2019, on which, the court below shall release the petitioner on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, Raxaul, Motiharim East Champaran, in connection with Raxaul P.S. Case No. 81/2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. It is further subject to the condition that petitioner shall cooperate in the investigation as well as in disposal of trial.
