JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 10.07.2015 Heard learned counsel for the petitioners as well as learned Addl. Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Bihiya P. S. case no. 35/2015 registered under sections 406, 420 and 504/34 of the Indian Penal Code.
Allegedly, petitioners played role of mediator in the negotiation of marriage of the informant's daughter and they took Rs 1, 60,000/- and ornament from the informant on the pretext to give the same to father of the groom. The contention on behalf of the petitioners is that the informant has lodged this false case when father of the groom did not agree for the marriage.
Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition
Patna High Court Cr.Misc. No.24523 of 2015 (2) dt.10-07-2015 is allowed and it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the above named petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara in Bihiya P. S. case no. 35/2015 subject to condition as laid down under section 438(2) of the Cr.P.C.
