JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-10-2017 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks regular bail in connection with Bakhtiarpur (Balwa Hat O.P.) P.S. Case No. 123 of 2017 for the offences punishable under Sections 392 and 414 of the Indian Penal Code.

The case of the prosecution is that on 05.05.2017 at 10:30 A.M. the informant along with his brother was going on his motorcycle and on the way they had stayed for urination when three miscreants came there on a motorcycle and robbed their mobile phones and motorcycle on pistol point. It is submitted that the petitioner has been arrayed in the case upon confessional statement of the accused persons Rajbail Yadav and Chandan Sah.

No.49688 of 2017 (2) dt.17-10-2017 2/2 Learned counsel for the petitioner submits that coaccused Chandan Sah has been granted bail by an order dated 23.08.2017 passed in Criminal Misc. No. 40039 of 2017 and the petitioner is languishing in jail since 16.08.2017. For the reasons stated hereinabove, more particularly the fact that the person on whose confessional statement, the petitioner has been arrayed as an accused, has been granted bail, I deem it fit and appropriate to enlarge the petitioner, namely Nagendra Yadav on bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in connection with Bakhtiarpur (Balwa Hat O.P.) P.S. Case No. 123 of 2017.
