Heard the parties.

Petitioner seeks bail in a case registered for the offences punishable under Sections 395,397,307 of the Indian Penal Code and Section 27 of the Arms Act.

The FIR under Section 397 IPC is against unknown. Name of the petitioner surfaced in the confessional statement of co-accused before the police while in police custody. Petitioner is in custody since 31.10.2020.

Submission is that the petitioner was never put on T.I. Parade during investigation of the case nor any incriminating article was recovered from his possession. Due to his criminal antecedent, the petitioner has been booked in the criminal proceeding.

No.27456 of 2021(2) dt.04-10-2021 2/2 Considering lack of direct material against the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Motihari Muffasil P.S. Case No.548 of 2019 with following conditions:

(a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
