The petitioner seeks bail in connection with Patahi P.S. Case No. 31 of 2017 registered for the offences punishable under Section 379 of the Indian Penal Code.
The name of the petitioner has transpired in the present case upon the confessional statement made by one Shivam Kumar and it has been alleged that the petitioner was involved in case of theft of motorcycles.
The learned counsel for the petitioner submits that the petitioner apart from the present case is an accused in two other cases and in both cases his complicity has come to fore upon the confessional statement of the co-accused namely Shivam Kumar. It is further submitted that apart from the aforesaid two cases the
Patna High Court Cr.Misc. No.32088 of 2018 (3) dt.19-07-2018 2/2 petitioner is not involved in any other case. Lastly, it is submitted that neither any recovery has been made from the possession of the petitioner nor any T.I. Parade has been held. The petitioner is stated to be languishing in custody since 06th February, 2018. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VIII, Motihari, East Champaran in connection with Patahi P.S. Case No. 31 of 2017.
