The petitioner nos. 1 and 3 are apprehending their arrest in a case instituted under Sections 304, 201/34 of the Indian Penal Code.

The accusation against the petitioner is of killing the daughter of the informant within two years of marriage. It has been submitted on behalf of petitioner nos. 1 and 3 that the petitioner nos. 1 and 3 are named in the FIR. Petitioner no.1 is the Devar and petitioner no.3 is the mother-in-law of the deceased.The husband of the deceased is in custody. It is also submitted that the petitioners have been made accused due to

Patna High Court Cr.Misc. No.22755 of 2015 (3) dt.21-09-2015 2/2 mistake of fact as they are separate in mess and property from the husband of the deceased.

It has been submitted on behalf of the State that the petitioners are named in the FIR.

Considering the aforesaid facts, let the above named petitioner, in the event of their arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Dehri, Rohtas in connection with Rohtas P.S.Case No. 99 of 2014, subject to the conditions as laid down u/s 438(2) Cr.P.C.
