Petitioner seeks bail in a case registered for the offences punishable under Sections 304B,211/34 of the Indian Penal Code.

Petitioner is husband of the victim of dowry death. He is in custody since 14.08.2019. The petitioner had taken a plea before the Bench hearing this matter earlier that the victim was carried for treatment to Varanasi where she died during course of treatment and dead body was cremated.

By order dated 10.07.2020 petitioner was directed to file supplementary affidavit alongwith the papers of treatment of the deceased as well as death certificate issued by the authority

Patna High Court CR. MISC. No.14175 of 2020(9) dt.03-12-2020 2/2 concerned. Though the petitioner has filed supplementary affidavit, however, no document of treatment has been produced rather petitioner has filed copy of the compromise petition filed before the learned court below.

Considering the nature of allegation against the petitioner and the fact that the offence is not compoundable, I am not inclined to enlarge the petitioner on bail in connection with Yadavpur P.S.Case No.78 of 2016 pending in the court of learned J.M. 1st Class, Gopalganj. Hence, prayer is refused. In the circumstances of the case aforesaid, the learned Trial Court is expected to dispose off the trial within six months. (Birendra Kumar, J) Nitesh/- U T
