2. The petitioner has prayed for bail in connection with Lohiyanagar P.S. Case No. 93 of 2025 registered for the offence punishable under Sections 140(2), 61(2), 103(3), 238, 3(5) of the B.N.S., 2023.
3. The case of the prosecution in short is that the brother of the informant namely, Bhola Mahto has gone to fetch vegetables with one Guddu Paswan. When Bhola Mahto did not return for considerable time, then the informant called Guddu, then Bhola said that send Rupees Five lakh. After this, the phone was disconnected. The informant asked Guddu Paswan and he disclosed that Bhola Mahto boarded in a vehicle at Somt Point. When the informant called Bhola, he replied that he was

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. He also submits that the petitioner is not named in the FIR. The name of this petitioner has surfaced on the basis of confessional statement of the co-accused, namely, Saurav Kumar. Nothing has been recovered from the conscious possession of the petitioner. He further submits that similarly situated other co-accused person namely, Saurav Kumar has already been granted bail by this court vide Cr. Misc. No. 8212 of 2026. Moreover, the petitioner is languishing in judicial custody since 25.11.2025.
5. The application for bail is opposed by learned APP for the State and submits that the petitioner is having criminal antecedent of eight cases.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief
