The petitioner seeks bail in anticipation of his arrest in connection with Sarmera P.S. Case No. 31 of 2018 dated 08.03.2018 instituted for the offences under Sections 406, 409, 420 and 120(B) of the Indian Penal Code.

The allegation in the FIR is that the petitioner and others have bungled in the supply of agricultural implements, for which subsidy was given by the government under the mechanization scheme.

Learned counsel for the petitioner has submitted that the amount of subsidy comes in the account of the seller of the agricultural implements and unless the amount is so deposited, the implements are

Be that as it may, it has also been submitted on behalf of the petitioner that the agricultural implements, in the supply of which bungling is said to have been committed, is worth Rs. 2700/-.

Considering the aforesaid facts, the petitioner above named is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-IV, Bihar Sharif, Nalanda in connection with Sarmera P.S. Case No. 31 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Ashutosh Kumar, J) krishna/- U T
