The petitioner is apprehending arrest in a case registered for the offences punishable under sections 420,272 and 273 of the Indian Penal Code and section 47(a) of Excise Act. It is alleged that from the house of the petitioner 200 liters of illicit spirit and 52 bottles each containing 400 ml of illicit country made liquor and other equipments of manufacturing and packing the liquor were recovered.

It is submitted by the learned counsel for the petitioner that the recovery has been made from the joint family house. Seizure list does not bear the signature of any family member of the petitioner. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

No.16671 of 2016 (2) dt.19-04-2016 2/2 The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Baikunthpur P.S. Case No. 207 of 2015 pending in the court of learned CJM, Gopalganj. This application is disposed of with the aforesaid observation/direction.
