The petitioner seeks regular bail in connection with Galgaliya P.S. Case No. 25 of 2018 (Special Case No. 76 of 2018) for the offences punishable under Sections 272 and 273 of the Indian Penal Code and Section 30(A) of the Bihar Prohibition and Excise Act, 2016.

The allegation is regarding recovery of 9 liters of foreign liquor from beneath the seat of the bus on which the petitioner was sitting.

The learned counsel for the petitioners submits that the petitioner has been falsely implicated in the present case and in fact no recovery has been made from the conscious possession of the petitioner. It is further submitted the petitioner is having a clean antecedent and is languishing in custody since 28.03.2018.

No.31925 of 2018 (2) dt.31-05-2018 2/2 Having regard to the facts and circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of learned Additional Session judge II-cum-Special judge, Excise, Kishanganj in connection with Galgaliya P.S. Case No. 25 of 2018 (Special Case No. 76 of 2018).
