2. This is the second attempt of the petitioner for grant of regular bail in connection with Sessions Trial No. 471 of 2024 arising out of Khagaria Muffasil P.S. Case No. 671 of 2022 registered for the offence under Sections 341, 323, 307, 302/34 of the Indian Penal Code.

3. As per the prosecution case, the allegation against the petitioner is of killing the husband of the informant.

4. The petitioner is in custody since 20.01.2023.

5. From the report of the trial Judge, it appears that out of 7 charge-sheeted witnesses only two witnesses have been examined and rest of the witnesses have not appeared.

6. Considering the allegations levelled against the petitioner and also considering the fact that the trial has proceeded, this Court is not inclined to grant bail to the petitioner.

7. Accordingly, this application is dismissed.

8. The Superintendent of Police, Khagaria is directed to ensure the attendance of the witnesses in the trial.

9. Let a copy of this order be communicated to the Superintendent of Police, Khagaria through FAX for its compliance.
