JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 2 12-06-2020 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the state through video conferencing. The petitioners seek pre-arrest bail in connection with Runnisaidpur P.S. Case No. 432 of 2019, registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. On receiving secret information about preparing and selling of illicit liquor in village Baligarh Dhangar, the informant and other excise official proceeded there. On seeing the vehicle of the excise department, about 20 persons started to flee away while they were chased, but, they succeeded in fleeing away taking the advantage of water nearby, but, Chowkidar, Baijnath Thakur, identified 12 persons, including the petitioners, out of them. Submission is that it would appear from the first information report that the petitioners were not apprehended on the spot rather their names have been disclosed by local Chowkidar. Further, submission is that the petitioners have no criminal antecedent and due to dirty village politics local Chowkidar disclosed the names of the petitioners.
Having regard to the facts and circumstances of the case, let the petitioners, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Runnisaidpur P.S. Case No. 432 of 2019 shall be released on bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional District Judge II-cum-Special Judge, Excise Act, Sitamarhi, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
