2. The petitioner seeks bail in connection with Bihapur (Bhawanipur) P.S. Case No. 709 of 2023 registered for the offence under Sections 363/366A/34 of the Indian Penal Code but the charge-sheet was submitted under Sections 363/366A/34 of the Indian Penal Code and under Section 4 of the POCSO Act.

3. As per the prosecution case, the petitioner is accused of kidnapping the victim girl.

4. From the reading of the FIR, it appears that the petitioner and the victim were in relationship.

5. Considering the aforesaid facts, this application is allowed.

6. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Spl. Judge, POCSO-cum-Additional District and Sessions Judge, VII, Bhagalpur in connection with POCSO Case No. 309 of 2023 arising out of Bhawanpur (Bihpur) P.S. Case No. 709 of 2023.
