JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 16-10-2017 Heard the counsel for the petitioner and the State. Prayer is for grant of bail in Routa P.S. Case No. 21 of 2017 registered under sections 302 and 307 IPC. Altogether 14 accused persons have been named in the FIR with an allegation that they assaulted Md. Shakib Zafar @ Lal Babu which subsequently resulted in his death. Learned counsel for the petitioner submits that the petitioner is not named in the FIR. Even in course of investigation no one said about the assault on the deceased by the petitioner. The petitioner has no criminal antecedents. He is languishing in jail since 05.07.2017. Drawing attention of the court to Annexure-2, it is stated that similarly placed coaccused Lal Babu @ Munna has been granted the privilege of

Patna High Court Cr.Misc. No.47554 of 2017(2) dt.16-10-2017 2/2 bail. He also submits that some other co-accused(s) of the present case who were named in the FIR have been granted the privilege of anticipatory bail vide order dated 21.09.2017 passed in Cr. Misc. No. 34610 of 2017.

In the circumstances, let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of ACJM-II, Purnea in Routa P.S. Case No. 21 of 2017 on condition that one of the bailors shall be his own/close family members.
