JUSTICE RAVI RANJAN ORAL ORDER 05-05-2016 Heard learned counsel for the petitioner and the State. The Petitioner apprehends her arrest in connection with Sultanganj P.S. Case No. 39 of 2015 registered for offence punishable under Section 366(A)/34 of the Indian Penal Code. It is contended on behalf of the petitioner that he is not named in F.I.R but in 164 Cr.P.C statement, the victim girl has taken her name alleging that she had locked the door of the room from outside. It is contended that vide Annexure-3 the main accused Sudhanshu Yadav has already been acquitted of the criminal charges finding case of no evidence against the accused person and the petitioner is a lady.
Having regard to the facts and circumstances of the case, let the petitioner, namely, Tuna Devi be released on bail in
Patna High Court Cr.Misc. No.18440 of 2016 (2) dt.05-05-2016 2/2 the event of arrest/surrender before the Court below within a period of six weeks from today in Sultanganj P.S. Case No. 39 of 2015, on furnishing bail bond of Rs. 10,000/- (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of criminal Procedure.
