The petitioner seeks bail in connection with Turkaulia (Raghunathpur) P.S. Case no. 283 of 2017 registered for the offence punishable under Section 120-B of the Indian Penal Code and under Sections 25(1-b)a, 26/35 of the Arms Act. One loaded country made pistol is said to have been recovered from the possession of the petitioner. It is submitted by the learned counsel for the petitioner that no incriminating article has been recovered from his conscious physical possession. The petitioner has been implicated in the case by police by showing fake recovery of fire

Patna High Court Cr.Misc. No.50490 of 2017 (2) dt.30-10-2017 arm from his possession. The petitioner has been languishing in custody since 23.05.2017.

Considering the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, District-East Champaran in connection with Turkaulia (Raghunathpur) P.S.
