Husband of the petitioner has served in the respondent-Force as a constable.

Counsel for the petitioner submits that husband of the petitioner is suffering from cancer. He refers to the order dated 11.02.2010 passed in CWJC No. 1019/2010 whereby this court taking note of the petitioner's medical

Patna High Court CWJC No.6236 of 2019(3) dt.18-07-2019 2/3 condition/ ground had directed the authorities to consider his request for transfer from Maharashtra to Mokama ghat. Pursuant thereto admittedly, petitioner has been at Mokama ghat for the last nine years. It is now in the month of February that there is direction for him to assume his joining in South Zone of the Force.

Petitioner's counsel submits that having regard to the medical condition, he should be allowed to continue in Mokama ghat.

Authorities on earlier occasion having regard to medical condition of the petitioner had considered his request favourably. It is for the respondent-authorities to consider whether the petitioner should be transfered or should be retained in Mokama ghat for which petitioner's husband has not made any request to the authority and approached this court directly by filing instant proceeding. In the circumstance, this matter is disposed of with liberty to the petitioner that husband of the petitioner may file an application with current medical condition for consideration.

Writ petition is disposed of with the aforesaid
