The petitioner apprehends his arrest in a case registered under Sections 147, 148, 149, 307, 120B, 504 and 506 of the Indian Penal Code and Sections 25(1-b)a, 26 and 27 of the Arms Act.

There was cross firing between two groups of people and one person namely Pandav Yadav @ Prahlad Yadav was apprehended by the police while others managed to escape. The apprehended accused disclosed the name of the petitioner and other accused persons as his accomplices in the occurrence. Police also recovered some empty cartridges at the place of occurrence.

Patna High Court CR. MISC. No.15133 of 2019(4) dt.19-06-2019 2/2 It is submitted by learned counsel for the petitioner that the petitioner has no concern with the aforesaid occurrence. He has been falsely implicated in the case due to dirty village politics. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. No incriminating article has been recovered from his conscious physical possession. No one sustained any sort of injury in the occurrence. Petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Khagaria in connection with Gogri P.S. Case No. 283 of 2014, G.R. No. 2826 of 2014, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
