2. The petitioner has prayed for bail in connection with Patahi P.S. Case No. 39 of 2011 registered for the offence punishable under Sections 341, 323, 307, 302, 504, 379/34 of the Indian Penal Code and Section 27 of the Arms Act.
3. The case of the prosecution, in short, is that the petitioner along with others was armed with weapon. The specific allegation of firing with country made pistol at the father of the informant is against one Anshu Singh due to which he succumbed to the injuries.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has

From perusal of the F.I.R. itself it is clear that the specific allegation of firing is against one Anshu Singh. Petitioner is only a member of mob and is alleged to be armed with weapon. He has not made any firing. No overt act is alleged against him. He is having no criminal antecedent and he is languishing in judicial custody since 01.12.2025.
5. Learned APP appearing for the State has vehemently opposed the application for bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Patahi P.S. Case No. 39 of 2011.
