JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 21-01-2015 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner, apprehending his arrest in connection with Chandauti P.S. Case No. 203 of 2004 registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code, seeks the privilege of pre-arrest bail. During the course of argument, finding the case not fit for pre-arrest bail, the learned counsel for the petitioner wants to withdraw this application with liberty to seek regular bail in the court below.

Accordingly this application is dismissed as withdrawn with liberty to the petitioner to surrender and seek regular bail and in that case the petitioner's regular bail

Patna High Court Cr.Misc. No.30502 of 2014 (2) dt.21-01-2015 application shall be disposed of on the same day, considering the submissions in right perspective without being prejudiced by this order.
