The petitioner is apprehending his arrest in connection with Ben P.S.Case No.109 of 2018 (G.R.No.4162 of 2018) dated 25.9.2018 , registered for offences punishable under Section 392 of the Indian Penal Code.
Prosecution story is of snatching of motorcycle of the informant by some miscreants and later on one co-accused was arrested and from whom his motorcycle was also recovered and it appears that the petitioner has been named by the coaccused in his confessional statement. Submission of the learned counsel for the petitioner is that he has no criminal antecedent and except confessional statement, there is nothing against him. It is also submitted that he has enmity with the co-accused as such he has named this petitioner.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Nalanda at Biharsharif in connection with Ben P.S.Case No.109 of 2018 (G.R.No.4162 of 2018), subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure with further condition that he will co-operate in the investigation and shall appear as and when required.
With the aforesaid direction, this application is allowed.
