Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is apprehending her arrest in Medni Chauki P.S. Case No. 120 of 2014 registered under section 409 of the Indian Penal Code.

According to the F.I.R. petitioner is an A.N.M. Health Sub-Centre Rasulpur, Surajgarha but she was transferred by the order of Civil Surgeon cum Chief Medical Officer, Lakhisarai as Additional charge of Primary Health Centre Pratappur, Halsi. She was relieved from Health Sub-Centre Rasulpur, Surajgarha. She was directed to handover the complete

Patna High Court Cr.Misc. No.23586 of 2015 (2) dt.06-07-2015 2/3 charge but she did not hand over the complete charge of health Sub-Centre Rasulpur, Surajgarha. It is also alleged that the accused petitioner withdrawn rupees from the scheme of Gramin Swachhata Samiti. The accused petitioner also made payment to the women for the Scheme of prasab but there was no any Government Register for account in the Health Sub-Centre Rasulpur. The accused petitioner was responsible for missing of the Government Registers and documents.

It has been submitted on behalf of the petitioner that petitioner has been made accused due to mistake of fact. She had not committed any fraud in respect of the fund allotted. It is further submitted that the petitioner is ready to deposit an amount of Rs. 15000/- which will be subject to the final result of the case. On behalf of the State it has been submitted that the petitioner is named in the first information report. Considering the aforesaid facts, it is directed that the petitioner shall deposit Rs. 15000/- in the court below which shall be subject to the final disposal of the case. On depositing the said amount, the above named petitioner in the event of his arrest or surrender before the court below within a period of four week from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail

Patna High Court Cr.Misc. No.23586 of 2015 (2) dt.06-07-2015 3/3 bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai in Medini Chauki P.S. Case No. 120 of 2014, subject to the conditions laid down under section 438(2) Cr.P.C.
