The petitioner apprehends her arrest in connection with Kadwa P.S. Case No.09 of 2022, registered for the offence punishable under Section 7 of the Essential Commodities Act. The prosecution story, in brief, is that on 07.01.2021, the accused/petitioner was carrying 48 bags of food grains by tractor for black marketing, but the same was apprehended by the villagers. On receiving information, the informant raided the shop of the petitioner and found shortage of 155.25 quintals of wheat and 264.81 quintals of rice and only 63.66 quintals of wheat and 95.49 quintals of rice were found in stock. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is further submitted that the petitioner is a PDS
Patna High Court CR. MISC. No.16973 of 2022(2) dt.18-08-2022 2/2 dealer and licence of shop of the petitioner has already been suspended. It is also submitted that the petitioner has got no criminal antecedent as stated in paragraph-3 of the bail application.
Taking into consideration the facts aforesaid, let petitioner, above named, in the event of her arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Katihar in connection with Kadwa P.S. Case No.09 of 2022, subject to the conditions laid down under Sections 438(2) of the Code of Criminal Procedure.
