This is an application for bail in connection with Narpatganj P.S. Case No. 83 of 2017 registered for the offences punishable under Section 395 of the Indian Penal Code. Petitioner is not named in the FIR and it appears that his name transpires during course of investigation. Submission of learned counsel for the petitioner is that one stolen motorcycle has been recovered from his house, as such, he has been made accused in this case and thereafter he has been remanded in this case. Further submission is that except confessional statement there is nothing against him, no recovery has been made from his possession and no test identification parade was held and he is in custody for five months.

Having heard both sides and in view of facts and circumstances, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-III, Araria, in connection with Sessions Trial No. 237 of 2017, arising out of Narpatganj P.S. Case No. 83 of 2017, subject to the following conditions :- (1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned, (2) Petitioner will mark his attendance in local police station in first week of every month till conclusion of trial, failing which his bail bond shall be cancelled.
