Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners apprehend their arrest in Patrakar Nagar P.S. Case No. 713 of 2019, registered for the offence punishable under Section 304(B) of the Indian Penal Code. It is alleged that sister of informant Sweety Kumari was married with Sanjeev Kumar Singh son of the petitioners on 24.02.2012. On 07.09.2019, the informant received information that Sweety has committed suicide. It is further alleged that due

Patna High Court CR. MISC. No.15918 of 2020(2) dt.14-07-2020 2/2 to non-fulfillment of demand of dowry they killed the sister of informant.

It is submitted that petitioners have been falsely implicated in this case. Petitioner no. 1 is father-in-law and petitioner no. 2 is mother-in-law. There is general and omnibus allegation. Petitioners are living separately and they have no concern with the affairs of the deceased and her husband. The husband of deceased has already been arrested. Learned APP however, vehemently opposed the prayer for bail and submitted that the deceased has been killed in presence of the petitioners.

Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate VIIIth, Patna in connection with Patrakar Nagar P.S. Case No. 713 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) vinita/- U T
