The petitioner has preferred this application for grant of regular bail in a case registered under section 392 of the Indian Penal Code.
As per the prosecution case, four accused persons looted the pick up van after hiring the same. It is submitted by learned counsel for the petitioner that the F.I.R. was registered against unknown. The petitioner was falsely implicated in course of investigation when his name was taken by co-accused Rohit Dubey in his statement made before police. It has falsely been stated that a stolen mobile phone was recovered from the petitioner's possession. The petitioner is in custody since 23.1.2021 and has no criminal

Having heard learned counsel for the parties and taking into consideration the facts of the case, the material that has transpired in course of investigation, the petitioner having remained in custody for more than 10 months and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Buxar (M) P.S. Case no.31 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar.
