13-05-2016 Learned counsel for petitioners submits that ofcourse this is the 2nd attempt for grant of anticipatory bail, but subsequently, even husband of the deceased and his brother have already been granted bail.

Normally, this Court is not entertaining 2nd anticipatory bail petition and while dismissing, this Court is directing the concerned Superintendent of Police to take appropriate steps, but in view of peculiar facts and circumstances, this Court proposes to dispose of the present petition, with an observation that petitioners may surrender before the court below and make a prayer for regular bail.

If such petition is filed, the learned court below may consider the bail petition, keeping in view the fact that husband of

Patna High Court Cr.Misc. No.19992 of 2016 (2) dt.13-05-2016 2/2 the deceased has already been enlarged on bail. The learned court below may pass final order on the bail petition preferably on the same date.

The petition stands disposed of.
