Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 302, 341, 379 of the Indian Penal Code. It is alleged sixteen accused persons including the petitioners came variously armed surrounded the informant when co-accused Hanshraj Yadav and Binod Sahni took Mahesh Sahni beside road and co-accused Pramod Yadav, Raj Kumar Yadav and Binod Sahni assaulted him with iron rod as a result of which he fell down on the earth and thereafter all the accused persons including the petitioners assaulted. It is submitted by learned counsel for the petitioners that accusation of assault against the petitioners is omnibus and general. The victim was a veteran criminal and was involved in eight cases.
Patna High Court Cr.Misc. No.25510 of 2015 (2) dt.01-07-2015 2/2 A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Let learned Court below consider the prayer for regular bail of the petitioners, if the petitioners surrender within a period of six weeks in connection with Hayaghat P.S. Case No. 98 of 2014, pending in the Court of learned Chief Judicial Magistrate, Darbhanga.
With the observations above, the application stands disposed off.
