JUSTICE ARVIND SRIVASTAVA ORAL ORDER 03-07-2020 Learned counsel for the petitioners seeks permission to withdraw the application of petitioner nos. 1 to 3, since during the pendency of this application, they have been arrested. Permission is accorded.
Accordingly, the application of petitioner nos. 1, 2 and 3 is dismissed as withdrawn.
Heard learned counsel for the petitioner nos. 4 to 6 and the learned A.P.P. for the State.
Patna High Court CR. MISC. No.14072 of 2020(2) dt.03-07-2020 2/2 The petitioner nos. 4, 5 and 6 apprehend their arrest in connection with Amdabad P.S. Case No. 198 of 2019 for the offence registered under Sections 341, 323, 354, 307, 379, 504 and 506/34 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioners submits that petitioners are innocent and have falsely been implicated in the present case due to land dispute. There is case and counter case between the parties. It is further submitted that both the parties have sustained injuries in the alleged occurrence. It is also submitted that the petitioners have no criminal antecedent.
Having considered the facts and circumstances of the case, let the above named petitioner nos. 4, 5 and 6 be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bail bond to the satisfaction of the C.J.M., Katihar in connection with Amdabad P.S. Case No. 198 of 2019, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
