JUSTICE MOHIT KUMAR SHAH ORAL ORDER 24-05-2018 Heard the learned counsel for the petitioners and the learned APP for the State.

The petitioners seek regular bail in connection with Pasraha PS case no. 32 of 2018 instituted for the offences punishable under Section 414 of Indian Penal Code. The allegation is regarding recovery of telephone wire from a tempo.

The learned counsel for the petitioners submits that neither any recovery has been made from the conscious possession of the petitioner nor the said tempo belongs to the petitioner nor the provisions of Section 100 Cr.P.C. has been complied with while making the seizure. It is further submitted that the petitioner is languishing in custody since 12.03.2018.

No.32255 of 2018 (2) dt.24-05-2018 2/2 Having regard to the facts and circumstances of the case, the abovenamed petitioners are directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) each with two sureties of the like amount each to the satisfaction of C.J.M. Khagaria in connection with Pasraha PS case no. 32 of 2018.
