The petitioners have preferred this application for grant of regular bail in a case registered under sections 286, 307 read with 34 of the Indian Penal Code and 3 / 4 of the Explosive Substance Act.
As per the prosecution case, on seeing the police two miscreants tried to flee away but they were apprehended by the police. On being asked, the apprehended persons disclosed their
Patna High Court CR. MISC. No.16014 of 2022(2) dt.20-07-2022 2/2 name as Bikas Ram and Dharmendra Ram. On search, two live explosives were recovered.
Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. Nothing has been recovered from the possession of the petitioners. The petitioners have clean antecedent as stated at para 3 of the bail petition. The petitioners are in custody since 15.12.2021.
Learned A.P.P. for the State has opposed the bail petition of the petitioners.
Considering the aforesaid facts and circumstances, the petitioners above-named, are directed to be enlarged on bail on his furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M, Bhagalpur, in connection with Jagdishpur P.S. Case No. 406 of 2021.
The application stands allowed.
