Petitioner, already in custody, seeks bail in connection with Barauni Rail P.S. Case No.26 of 2018 registered under Sections 414 and 401 of the Indian Penal Code. Allegation in brief is that petitioner after committing theft of a trolley bag jumped out of the running train and thereafter over powered by the security personnel and apprehended.
Learned counsel for the petitioner submits that on mere suspicion, the petitioner was apprehended as there is no claimant of the bag and there is no report regarding the theft. However, the petitioner was apprehended red handed in the matter and has also criminal antecedents of similar nature, so at
Patna High Court Cr.Misc. No.37363 of 2018(3) dt.12-07-2018 2/2 present the Court is not inclined to grant bail to the petitioner. Accordingly, the prayer of bail of the petitioner is rejected.
However, the petitioner may renew his prayer of bail after six months.
