JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 20-07-2022 Learned counsel for the petitioner is permitted to remove defect (s), as pointed out by the office, if any, within a period of four weeks on resumption of physical mode. Heard learned counsel for the petitioner and learned APP for the State.

The petitioner has preferred this application for grant of regular bail in a case registered under sections 380/457 of the Indian Penal Code.

As per the prosecution case, Rs. 85,000 and other costly things were stolen by the thief after entering the said shop of the informant.

Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this

Learned counsel further submitted that a wrench size 12-13 in number was recovered from the house of the petitioner. The petitioner is also accused in two other criminal cases which is of similar nature. The petitioner is in custody since 28.12.2021.

Learned A.P.P. for the State has opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances, the petitioner above-named, is directed to be enlarged on bail on his furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Bettiah, West Champaran, in connection with Purushottampur P.S. Case No. 105 of 2021. The application stands allowed.
