Heard the parties in virtual Court.

The petitioner is languishing in custody for the offence punishable under Sections 341, 323, 504, 506, 379 and 307/34 of the Indian Penal Code.

Two persons allegedly caused injury with iron rod at the head of the informant. One was the petitioner and another was co-accused Arvind Singh. The doctor found single injury on the forehead of the informant.

Submission is that it is difficult to attribute one of the two, to have caused said single injury. Petitioner is in custody since 07.01.2021. Investigation of the case is already complete. Petitioner is aged about 74 years. There is case and counter case. Considering the facts aforesaid, let the petitioner,

Patna High Court CR. MISC. No.27373 of 2021(2) dt.01-10-2021 2/2 above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Chhabilapur P.S. Case No. 128 of 2019, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
