JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-05-2016 The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 406, 420, 120B, 384, 34 of the Indian Penal Code. The prosecution case is that the informant purchased four katha of land through three registered sale deeds executed in favour of informant, her sister-in-law and mother from Mosmat Dhanmati Devi and subsequently the name of the purchasers were mutated. It is alleged that on 02.08.2014 when the informant started making construction then petitioners claimed the land by virtue of the gift deed executed by Mosmat Dhanmati Devi to her mother. It is submitted by learned counsel for the petitioners that petitioners' side filed Title Suit No. 784 of 2015
Patna High Court Cr.Misc. No.20415 of 2016 (2) dt.11-05-2016 2/2 wherein parties have entered into compromise and statement has been made in para 2 of the compromise petition that petitioners will not claim any title for the possession of the land in question.
A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Muffasil P.S. Case No. 250 of 2014, G.R. No. 3758 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
